Welcome to AutoPodcast.ai. By accessing or using this Platform, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use the Platform. These terms constitute a legally binding agreement between you and AutoPodcast.ai.

1. The Service

AutoPodcast.ai is an AI-powered platform that curates publicly available news and information, generating podcast episodes and blog articles through artificial intelligence. The Platform's purpose is to democratize access to information, delivering the most relevant and trending news in a quick, compiled, and easy-to-consume audio format. All content on the Platform is generated exclusively by the administrator through AI systems — users consume, interact with, and organize content but do not create podcasts.

2. AI-Generated Content — Disclaimer

ALL content on AutoPodcast.ai (including audio episodes, transcripts, blog articles, summaries, and images) is generated by artificial intelligence. While we strive for accuracy and quality, AI systems can make errors, produce inaccurate information, misinterpret sources, or generate content that does not fully reflect the original news (commonly known as "AI hallucinations"). THEREFORE: (a) We make NO guarantees regarding the accuracy, completeness, timeliness, or reliability of AI-generated content; (b) We STRONGLY RECOMMEND that you always verify information by consulting the original source links provided with every episode and article; (c) AutoPodcast.ai shall NOT be held liable for any decisions, actions, or damages resulting from reliance on AI-generated content without independent verification; (d) The content is provided for informational and entertainment purposes only and does NOT constitute professional advice (legal, medical, financial, or otherwise).

3. Original Sources and Attribution

AutoPodcast.ai exclusively consumes publicly available content (news articles, public reports, press releases) as source material for AI-generated episodes. We always provide links to the original sources so users can access the full original content. Our platform presents information in a different format (audio podcast and blog summary) while always attributing and linking to the original source. This constitutes transformative use and fair use of publicly available information — it is NOT plagiarism. All original content remains the intellectual property of its respective publishers, and we encourage users to visit the original sources.

4. Public Access vs. Registered Experience

All podcast content on AutoPodcast.ai is publicly available and can be accessed without creating an account. Registration is entirely optional and exists solely to enhance the user experience by providing features such as: podcast subscriptions, listening history tracking, personalized email digests, episode favorites, and content sharing. If you do not wish to share any personal data, you may freely use the Platform without registering — the full content catalog remains available to all visitors.

5. Your Account

When you create an account (via Google OAuth 2.0 or magic link email), you agree to: (a) provide accurate information; (b) maintain the security of your account; (c) accept responsibility for all activities under your account. We authenticate via OAuth 2.0 (currently Google, potentially other providers in the future) to simplify login and collect only the minimum data necessary (name, email, profile picture). We do not store passwords.

6. Consent Upon Registration

By creating an account on AutoPodcast.ai, you expressly consent to: (a) the collection and processing of your personal data as described in our Privacy Policy; (b) the use of your email address and Platform browsing behavior for personalized advertising purposes, under the conditions specified in our Privacy Policy (no data is ever shared with third-party advertisers); (c) receiving service-related communications and, if opted-in, email digests; (d) the tracking of email engagement (opens, clicks) and link interactions for service improvement purposes. This consent is given freely, and you may withdraw it at any time by deleting your account — which will result in the permanent erasure of all your personal data as described in our Privacy Policy. If you do not wish to provide consent, simply do not create an account and continue enjoying the publicly available content.

7. Content and Intellectual Property

All podcast content, audio, AI-generated images, blog articles, and the Platform's design and code are the property of AutoPodcast.ai or its licensors, protected by applicable intellectual property laws. You may: (a) listen to, read, and share content for personal, non-commercial use; (b) share links to episodes and articles on social media and other platforms. You may NOT: (a) reproduce, distribute, or commercially exploit Platform content without prior written authorization; (b) use automated systems to scrape, copy, or download content in bulk; (c) remove attribution or source links from shared content.

8. Acceptable Use

You agree NOT to: (a) use the Platform for any illegal purpose; (b) attempt to gain unauthorized access to our systems or other users' accounts; (c) transmit malware, spam, or malicious content; (d) interfere with the Platform's operation or infrastructure; (e) misrepresent your identity or impersonate others; (f) use the Platform to harass, defame, or harm others; (g) circumvent or disable security features of the Platform.

9. Termination

We may suspend or terminate your access if you violate these terms, with or without prior notice. You may delete your account at any time through your profile settings, which will initiate the data erasure process described in our Privacy Policy. Upon termination: (a) your right to use the Platform as a registered user ceases immediately; (b) you retain the right to access publicly available content as an unregistered visitor; (c) the data deletion process outlined in our Privacy Policy will be followed.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) AutoPodcast.ai is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory; (b) We disclaim all warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement; (c) We are NOT liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: your use of or inability to use the Platform; any AI-generated content errors, inaccuracies, or hallucinations; any decisions or actions you take based on Platform content; any unauthorized access to or alteration of your data; any interruption or cessation of service; (d) Our total aggregate liability for any claims shall not exceed the amount you have paid us in the 12 months preceding the claim (if applicable), or EUR 100 / BRL 500, whichever is greater; (e) Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless AutoPodcast.ai, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights.

12. Changes to These Terms

We may update these Terms of Use periodically. Material changes will be communicated via email to registered users and/or through a prominent notice on the Platform at least 30 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the updated terms. If you disagree with the changes, you may delete your account before the new terms take effect.

13. Governing Law and Jurisdiction

These terms are governed by the laws of the Federative Republic of Brazil. For users located in the European Union, mandatory consumer protection provisions of your country of residence shall apply to the extent they provide greater protection. Any disputes arising from or related to these terms shall be submitted to the courts of the city of São Paulo, state of São Paulo, Brazil, without prejudice to your right to bring proceedings in your country of residence if required by applicable law.
